01. Non-Binding Offer & Illustrative Pricing

Information, estimates, monthly lease amounts, equity accrual metrics, and buyout figures published on this website are provided strictly for illustrative educational and preliminary planning purposes. Nothing on this website constitutes a binding offer of financing, a commitment to lease, an extension of credit, or a guarantee of equipment delivery.

Formal binding obligations are created solely upon mutual execution of written, definitive lease agreements, term sheets, and colocation service contracts between the lessee and the operating entity. All transactions are subject to final underwriting, verification of customer identity, commercial credit review, and hardware allocation availability.

02. Privacy Policy & Waitlist Data Use

We treat your contact and workload information with strict confidentiality:

  • Scope of Collection: When you submit our interest form, we collect your name, email address, optional workload notes, submission timestamp, referral metadata, and coarse IP country.
  • Exclusive Purpose: We use your information solely to maintain our hardware reservation queue, send capacity availability notices, and deliver requested term sheets.
  • No Data Resale: We never sell, rent, monetize, or disclose your contact information to third-party advertisers or marketing data brokers.
  • Operator Privacy: In alignment with security best practices, the operator does not publish personal direct phone numbers or email addresses on this website; communications are conducted through designated operational accounts.
  • Data Retention & Deletion: You may request removal from our waitlist database at any time by replying to any communication or submitting an online Waitlist Removal Form.

03. Export Administration & NVIDIA Compliance

NVIDIA DGX Spark hardware incorporates high-performance artificial intelligence semiconductors governed by United States export control laws, including the Export Administration Regulations (EAR) administered by the U.S. Department of Commerce Bureau of Industry and Security (BIS).

Access to hardware nodes, network tunnels, and colocation infrastructure is conditioned upon compliance with all applicable export restrictions. Customers represent and warrant that they are not located in, organized under the laws of, or ordinarily resident in any country or territory subject to comprehensive U.S. sanctions, and are not identified on any denied party or restricted entity lists.

04. Disclaimer of Tax and Accounting Advice

Spark Lease does not provide legal, tax, financial, or accounting guidance. The tax treatment of equipment leases, lease-to-own arrangements, capital versus operating leases, and Section 179 depreciation deductions varies depending upon the jurisdiction, structure, and accounting standards of each individual business entity.

Customers must consult their independent Certified Public Accountant (CPA) or corporate legal counsel to determine the appropriate financial and tax characterization of any proposed lease-to-own agreement.

05. Operating Entity & Timing Disclosures

All customer agreements will be executed with the designated operating Limited Liability Company (LLC in formation). Any transitional activities conducted prior to formal LLC finalization are managed under sole proprietorship structure and will be assigned to the LLC upon organization.

Availability schedules, deployment dates, and rack provisioning timelines are subject to upstream hardware delivery from NVIDIA authorized distributors and data center colocation power commissioning in the Burbank–LA metro.
